Nicklinson widow launches article 8 appeal

The widow of locked-in syndrome victim Tony Nicklinson is to pursue the appeal that her late husband would have brought if he was still alive, it emerged today.

Nicklinson failed to convince the High Court in mid-August that friends and doctors should be allowed to help him die without risking prosecution. He died on 22 August after refusing food and fluids. His widow Jane, as his former wife and carer, is now to lodge an application for permission to appeal the High Court decision. The British Humanist Association has also applied to intervene in the case.

Border agency ‘cynicism’ behind appeal losses

‘Bad and cynical’ decision making lies behind the UK Border Agency’s (UKBA) continued record of losing half of all appeals against orders to remove immigrants and failed asylum seekers, it was alleged today.

Joint Council for the Welfare of Immigrants legal policy director Hina Majid told the Gazette: ‘Our experience of immigration and asylum casework is that we still see a lot of careless, bad and cynical decision making by the UKBA – and the high success rate on appeal is simply consistent with what we see on the ground.’
