Lawyers unaware of pro bono costs orders, charity warns

Legal charities are missing out on funding because the majority of lawyers are unaware of the existence of ‘pro bono costs’ orders, research has suggested.

Where a civil case is won by a lawyer providing free legal representation, under Section 194 of the Legal Services Act 2007 pro bono costs can be awarded by the court or included in settlements.

The costs are paid by the losing party to the Access to Justice Foundation, which distributes the funds to legal charities.

Oversupply of lawyers to drive down costs, says Green

The oversupply of qualified lawyers denied entry to the profession has led to a ‘burgeoning body of paralegals’ that will have a profound effect on solicitors and barristers, former bar chairman Nick Green QC said last week.

At a conference on legal education in London last week, Green said the paralegal market, which is ‘burgeoning at an alarming rate’, is one of the biggest challenges to face the professions.

He said: ‘The burgeoning body of paralegals is already affecting the structure of the profession, and will do so increasingly in the near future.’

Government unveils overhaul of legal aid and civil litigation costs

Legal aid providers as a whole will see their income slashed by up to £154m annually, it emerged today, as the government unveiled its plans for reform of the system.

A wide range of civil cases will no longer be eligible for legal aid, and fees paid in civil and family cases will be cut by 10% across the board, according to Ministry of Justice plans set out in a consultation paper, Proposals for the Reform of Legal Aid in England and Wales, released today.
