LCJ warns of technology threat to justice system

The lord chief justice has today warned of the need to preserve the integrity of the trial and jury system in the face of risks posed by modern technology.

In his foreword to the Court of Appeal Criminal Division’s annual review of the Legal Year, Lord Judge stressed: ‘Modern technology does not come without risks.’

He said: ‘I remain concerned at the ease with which a member of the jury can, by disobeying the judge’s instructions, discover material which purports to contain accurate information relevant to an individual case or an individual defendant.

US technology companies fuel tribunal claims

US computer technology companies are fuelling a rise in cases heard by the Company Names Tribunal, research has suggested.

Since its formation in October 2008, 24% of claims in the tribunal have been filed by American IT conglomerates, according to research by legal publisher Sweet & Maxwell.

Intel Corporation has brought 15 claims against companies for using the word ‘Intel’ in their name, while Sun Microsystems has filed six actions for unlicensed use of its Java name, the research found.
